I am definitely not an expert but I do know that [most, if not all] homebrew is not illegal. The Homebrew Channel ''is'' an unauthorized modification and it ''does'' void your warranty, but that doesn't mean it's illegal. The HBC was created and coded by Team Twiizers and uses no code from Nintendo so it is completely legal. There are some homebrew apps that are of questionable legality but they are not permitted here on WiiBrew. All Nintendo is saying is that your warranty will be null and void and you may be banned from using online services if you use unauthorized software. It has been reported many times that people who cheat in online games (using homebrew such as Gecko OS) will be banned. Nintendo has the right do that and to remove unauthorized software with an update as long as they inform users that this software will be removed (and they always do).
